LIVE PERSONAL PROPERTY AUCTION IN CROFTON, KY

Terms and Conditions:  

PLEASE READ AND REVIEW THE TERMS & CONDITIONS THOROUGHLY PRIOR TO BIDDING IN ANY AUCTION. IF YOU HAVE NOT READ AND UNDERSTAND THESE TERMS, DO NOT BID. BY BIDDING IN THE AUCTION, BUYER AGREES TO ALL TERMS AND CONDITIONS SET FORTH AND ENTERS INTO A CONTRACTUAL AGREEMENT TO PURCHASE ANY ITEMS WON DURING THE AUCTION UNDER THE FOLLOWING TERMS AND CONDITIONS:

Auction Location: 169 Poole Mill Road, Crofton, Kentucky

Bidding Begins: Saturday, July 27th at 10:30 am, or immediately after the Real Estate Sells at 10am.

Age Requirement: All bidders must be at least 18 years of age or older. Bidder must be at least 18 years of age to purchase firearms and ammunition for rifles or shotguns. However, for firearms other than rifles and shotguns and ammunition for such other guns, the minimum age requirement is 21 years.

Buyer’s Premium: There will be a 10% Buyer's Premium added to the final bid and will be included in the total sales price.

Taxes: Applicable 6% KY Sales Tax applies unless an exemption certificate is provided before checkout. 

Payments: Payments by ALL successful bidders can be paid by wire transfer (online bidders only--plus an additional $20 fee), cash, check, or credit card (plus a 3% processing fee).  All successful online bidders will receive their invoices via email from Bolinger Real Estate and Auction at the conclusion of the auction and payments are due on receipt. Full payment of all items must be made prior to the removal of the items. In-person bidders are required to make payments promptly after all items are sold.

Removal: All items must be removed at the conclusion of the auction on 07/27/2024. Anything left after that time will be considered abandoned property and will become property of the auction company.  Buyer is responsible for all loading and disassembling of the purchased items.

Refunds: No refunds or adjustments will be made once an item has been removed from the auction site. All refunds and adjustments are solely at the discretion of the auction company.

Disclaimer & Absence of Warranties: All information contained in this brochure and all related materials is subject to the Terms and Conditions outlined in the Purchase Agreement. The property is being sold “AS IS, WHERE IS” basis, and no warranty or representation, either express or implied, concerning the property is made by the Seller or Auction Company. Each potential bidder is responsible for conducting his or her own independent inspections, investigations, inquiries, and due diligence concerning the property. Further, Seller disclaims any and all responsibility for Buyers safety during any physical inspection of the property. No party shall be deemed an invitee of the property by virtue of the offering of the property for sale. 

Online Bidder Registration: The person agreeing to these terms is personally responsible for any bids placed on this auction, whether bidding on behalf of their personal account or on behalf of a corporation or other third party. If you are bidding on behalf of a third party, you are responsible for obtaining the necessary documentation authorizing you to bid on behalf of the third party. Bolinger Real Estate & Auction will look to the herein registered bidder for performance on any bid placed on this auction if you are the successful high bidder.

Seller Representation: Bolinger Real Estate & Auction represents the Seller in this transaction.

Credit Card Authorization: It is a requirement to enter a valid credit card in order to bid online in ANY auction on our website. The card entered will be authorized for $1.00. If bidding in a real estate auction, your down payment will need to be in the form of wire transfer or check. See Down Payment terms above for more information.

Bidder Information & Security: All registration information the bidder provides to Bolinger Real Estate & Auction, LLC shall be current, complete & accurate. All bidders are responsible for any bids placed under their bidding numbers and password. The security of bidder information is the responsibility of the bidder. Bidders must notify Bolinger Real Estate & Auction, LLC if they believe that their bidder number and password have been compromised.

Technology Disclaimer: Bolinger Real Estate & Auction, its affiliates, partners and vendors, make no warranty or guarantee that the online bidding system will function as designed on the day of sale. Technical problems can and sometimes do occur. If a technical problem occurs and you are not able to place your bid during the live auction, Bolinger Real Estate & Auction., its affiliates, partners and vendors will not be held liable or responsible for any claim of loss, whether actual or potential, as a result of the technical failure. I acknowledge that I am accepting this offer to place bids during the auction over the Internet or over the phone.

Conduct of the Auction: Bolinger Real Estate & Auction, LLC reserves the right to reject any and all bids for any reason and also reserves the right to cancel this auction, or remove any item or lot from this auction prior to the close of bidding. All decisions of Bolinger Real Estate & Auction are final.

Firearms Terms & Conditions:

KNOW YOUR STATE’S GUN LAWS PRIOR TO BIDDING

Bidder Requirements:

• Bidder must be at least 18 years of age to purchase firearms and ammunition for rifles or shotguns. However, for firearms other than rifles and shotguns and ammunition for such other guns, the minimum age requirement is 21 years.
•  The bidder must be a legal resident of the United States to bid on firearms.
•  Out-of-state bidders of guns may bid on firearms so long as they comply with the laws of their state. 
• The registered bidder must be the one to pay for the auction firearm(s), pass the background check, and receive/pick up the firearm(s).
• Using YOUR firearms knowledge and experience, form your own opinion of the firearm and bid accordingly. If in doubt, DO NOT BID. All guns are sold as is, where is. We do not test fire each gun and, therefore, do not guarantee that they will fire correctly or function correctly. We are not gunsmiths and do not take guns apart – we cannot confirm if all the internal parts are present on any given firearm. All gun sales are final.

Pick-Up Location & Background Check:

• At the conclusion of the auction, Buyers must pay for their auction items, and all firearms will be taken to Lancaster Guns. Firearms will not be given to the buyer on the day of the sale.
• Firearms will be available for pick-up, pending a Background Check, at Lancaster Guns, 257 Emilys Way, Cadiz, Kentucky, starting Tuesday, July 30th after 11:00 am.
• Buyers must present a valid ID matching the registered bidder's name.
• The background check fee is $5 with a Conceal Carry License or $20 without, paid by the buyer.
• Failure to pass the background check will result in forfeiture of all money & the purchase of the firearm(s).  If in doubt, DO NOT BID.

YOUR BID ON THIS AUCTION INDICATES BOTH AN UNDERSTANDING AND AN ACCEPTANCE OF THE TERMS OF THIS CONTRACTUAL AGREEMENT BETWEEN YOURSELF AND BOTH THE SELLER AND BOLINGER REAL ESTATE & AUCTION AND THAT YOU, AS THE BIDDER, ARE PREPARED TO PURCHASE THE PROPERTY UNDER THE TERMS AND CONDITIONS OF THIS AUCTION.

ANY ANNOUNCEMENTS MADE BY THE AUCTION COMPANY AT THE AUCTION PODIUM DURING THE TIME OF THE SALE TAKE PRECEDENCE OVER ANY PREVIOUSLY PRINTED MATERIAL, OR ANY OTHER ORAL STATEMENTS MADE.
